There are currently two government consultations open that have significant implications for the adult social care sector. Both relate directly to workforce sustainability, recruitment and long-term planning, and we encourage providers and stakeholders to be aware of the proposals and engage where possible.
Fair Pay Agreement Consultation
The government is consulting on the introduction of a Fair Pay Agreement for adult social care.
This consultation invites feedback on:
- Who and what should be covered by a Fair Pay Agreement
- How the negotiation and bargaining process could operate
- How disputes might be resolved
- How any agreement would be implemented and enforced
Importantly, this consultation does not seek views on pay levels or specific terms and conditions. Any outcomes on pay or conditions would be determined through a future bargaining process, not through this consultation.
Given ongoing workforce pressures, recruitment challenges and the link between pay, retention and service sustainability, this consultation is highly relevant for providers across the sector.
Earned Settlement Consultation
The government is also consulting on reforms to the UK settlement system, which determines how migrants gain the right to live permanently in the UK (also known as indefinite leave to remain).
The proposals, set out in the 2025 Immigration White Paper “Restoring Control over the Immigration System”, introduce a fundamental shift in approach. Settlement would no longer be granted automatically after a fixed period. Instead, individuals would be required to earn settlement by demonstrating sustained good conduct, contribution and integration over time.
These changes are particularly relevant to social care, which relies heavily on international workers to maintain safe staffing levels and support wider health and care system capacity. The consultation seeks views on how the current system should be reformed and how any changes should be implemented.
